The police reports make your request for restraining order more believeable to the judge, even if the police could not find the guy when they arrived. Get the police report numbers, get copies of the police reports, and go to family court to get a packet on how to fill in the restraining order. It is not hard and the courthouse staff is very helpful. Stalking is very easy to enforce with a "stay away" RO and the judge wants to err on the side of safety, so you don't have to prove much, just state your case. If you live in California, threats to harm you are criminal, so if he made those, state them specifically in the request.
